Community Property Versus Separate Property

When the property from a marriage is being divided, the court will look to determine what property constitutes the community property of the marriage as opposed to the separate property of the individual spouses. Property acquired prior to the marriage is considered as separate property. Property acquired during the marriage is generally considered to be community property. Exceptions include gifts and inheritance to an individual spouse. Even these, however, can lose their designation as separate property if they are not handled properly.
