Rights and Obligations between Spouses

In California, spouses have an obligation to share all information available with each other and be accountable to the other for financial transactions affecting the other's potential or real interests.  Unfortunately, a divorce can prompt a game of hide and seek as spouses attempt to conceal assets or divert funds into secret accounts in order to keep money and property away from the other spouse.

The Family Code imposes rules to control the actions of spouses regarding the confidential (fiduciary) relationship they have with one another. Under the Family Code, spouses cannot take an unfair advantage of each other due to their confidential relationship, which is “…subject to the same rights and duties of non-marital business partners….” It also imposes a duty of the highest good faith and fair dealing on each spouse. The Family Code also maintains the management and control of the couple’s assets and liabilities by the managing spouse until they have been divided by the couple or by a court.
